Legal Question in Family Law in New York
Equitable Child Support Amount
Working with Mediator on Legal Separation. My amounts of Maintenace and Child Support for our two children have my monthly income need in the ''RED''. The mediator just looks at me and says it is to bad - I need to find other employment to suppliment the need. My wife has part time employment , yet has a perm NYS Teachers License. She refuses to leave her part time work because she wants me to pay for everything. What happened to basing amounts of support on her ability to be employeed at higher levels of income? Why have a dad $1000.00 in the hole each month...I thought my needs of daily living was assessed in this...this is frustrating. I feel like I am supporting a person that can definetly support themsleves and the kids better so that my monthly finances can be slacked up...

Re: Equitable Child Support Amount
As I'm sure you're aware, mediation is not binding. It is obviously unreasonable for the mediator to suggest that you should pay support that exceeds your actual income. If this is the case, you should prepare to litigate. Feel free to call me at 212-367-9167 if you wish to discuss your case. I do not charge a fee for the initial consultation.
