we analized our pensions and i owe 150k..this pension is nycers and does not allow a lump sum distribution...we also own a house where she has continued to live for the past 3 years..we have 3 children who live with her...can i ask the courts for my 1/2 of the house..which is around 150k...and ask the court to let her take half of my monthly pension which is 1,300..or will the courts offset my half of the house with what i owe in the pension, even though it is not a lump sum distribution pension..thanks

Re: equity

You can ask for whatever you want. A lot more goes into distributing assets than the information you provided, and it is not necessarily a 50/50 split. You need to consult with an attorney for an accurate assessment. Feel free to call me at 212-367-9167 to discuss this in further detail. I do not charge a fee for the initial consultation.
