Establishing Paternity : Child Born out of Wedlock

Husband received court papters for child support, from a woman who states he is the father. Husband did not acknowledge paternity at the time of child birth. Mother put his name on the birth certficate w/o his knowledge and the child has his name. next court date is 01/22/03. What are his rights and what is mine as his wife. We have a 2 yr old son and at the time of his birth we were not married. he (husband) had to file a document of acknowledging our son in order for him to have his name. why did this woman do it w/o his knowledge.

This is a contested paternity test and you have the right to have a DNA / Blood test, among other defenses.

Your best course of action is to take the paternity test to determine paternity conclusively.
