Legal Question in Family Law in New York

estate money

I want to file for divorce, will my husband be able to get half the money I receive from my fathers estate!! Also I have three children who will have to leave the home when I file me or him? We own but it is in his name!!

Ordinarily inheritances are not marital property, that is, they belong to the person who inherited it. As to homes, names aren't particularly important; what is important is whether the home was acquired during the term of the marriage, and how it has been paid for.

Bottom line: Divorce is complicated, particularly when children and property are involved. You should contact an attorney in your area for help with your case.
