Legal Question in Family Law in New York

Evidence of adultry in divorce

My wife has been sneaking around and I found a piece of paper which she wrote the names and address's of motels in the area. She circled one which I believe is where she meets the man. I took it and made photo copies. Should I return it to where I found it or keep it? I want to hire someone to follow her and dont want her to know I know so she changes where she meets him. Will a photocopy work in a court of law?

Re: Evidence of adultry in divorce

There are any number of competent Private Investigators who do that type of matrimonial investigation. However, before you go to that expense, you should know that in New York evidence of adultery is not considered a factor in distribution of property and/or money - it's merely grounds for a divorce without a waiting period.

As to evidence of adultery, a photocopy is fine - but it isn't much evidence, without supporting photographs of your spouse actually at the motel with someone else.
