Legal Question in Family Law in New York

My exboyfriend is in prison. We have an 11 year old son..How can i get full custody of my son and does my son have to go see him in prison ?

Q. How can i get full custody of my son?

A. You have de facto custody since the father is in jail. However, you may still file a petition with Family Court seeking full custody.

Q. does my son have to go see him in prison?

A. Unless there is a court order the answer would be no.
