Legal Question in Family Law in New York
My exhusband and I got divorced two years ago. I was awarded full occupancy until furthur notice. I now want to try to sell the house but he is on the deed. He isnt on the mortgage and we have no equity in the house. I am no longer in contact with him. How do I get his name off of the deed to the house without his signature.

Well, I would not say you can't... not yet. I would say that I would have to read the terms and conditions under the settlement agreement. If the settlement agreement directed the ex to deliver title to you, you may be able to have the title transferred by the Court. If the husband has an interest in the house, then, you can't.
