Legal Question in Family Law in New York

false acusations of child abuse

I ws tricked into letting a CPS person in my home. He told me there were questions of the safety of my children. My child(16) stated she feared for her safety and her brothers according to cps, cry and shaking. He had to investagate house or he was taking my kids. I signed papers not even reading one wasn't even filled in.(I wasn't thinking-''he's going to take my kids). child recorded conversation with both counselor and cps. with them telling my child not to listen to me. I'm lying they never said such a thing. what are my rights in regards to recinding paper work and getting them to release all papers from this case so I know where I stand.

Re: false acusations of child abuse

This is a very serious matter which could involve all of your children being taken away.

It is no excuse to say that you did not read the papers before you signed them.

I don't know what you signed, and you should make a written request to obtain a copy of this document.

You should obtain a lawyer immediately to protect what rights you have left.

You will in the future receive a statement from the CPS stating if the acts complained of were founded or unfounded. If unfounded it goes away. If founded you must seek legal advice immediately,

you don't want this on your record.

afterward you can request a copy of their file in writing.
