Family court non-custodial parent to pay additional support will force me into B

Currently, I am paying 29% of adjust Gross salary for childsupport. Custodial parent has filed a petition to request from family court additional monies for child care (nanny) , and Grammer School fees for my 4yr old. Will the court grant Custodial parent above additional support while leaving me but no choice to file for Bankruptcy in order to pay said funds. Currently , I am living pay check to pay check with no savings or 401k. My expenses(including childsupport) exceed my current income. I have filed for a downward modification of childsupport.

You are going to get slaughtered if you do not have proper legal representation. That is the story from dozens of fathers who thought they could buck-n-wing it through a child support hearing. They usually end up with even worse legal headaches.

You can fight for a downward modification or a totally new negotiated arrangement with the mother. But bankruptcy won't save you from the child support vultures.

Here's the bad news: bankruptcy won't change your child support obligation, or any court ordered obligation. I suggest you negotiate with the custodial parent.
