Legal Question in Family Law in New York
my family law attorney never returned my calls for over 3 months. I made serveral phone calls and sent emails, now, after 3 months, I heard from him today, the trial to see if the judge will reopen the case because the respondent committed financial fraud is tomorrow. What should I do. Can I postpone it? I am not prepared, but the attorney says that we are and wants us to go through with it. I don't think that I can trust him. I also feel that he may be working or have cut a deal with the respondents attorney, who he is on good terms with. FYI, the respondent is an extremely successful real estate broker, I barely get by supporting our daughter. He lives 10 minutes away in a 4 bedroom home but refuses to see her (she's 11). My daughter and I live in a 1 bedroom apartment. He is filing a downward modification, and also has hidden his additional income in a foriegn bank account. He made $400,000 to $1,000,000, but because of "expenses" he and his account has narrowwed it down to $54,000. I make #46,000 a year. What are my rights? and will an already annoyed magistrate listen to me? How can I communicate with this attorney?
