Legal Question in Family Law in New York
Family Law (Harassment?)
Live with my 16 yo son's father; in February 2007 son's father and stepson (age 25) installed a 'heatlock' over the thermostat. This is just one of the 'new' things he is doing to make life difficult for me.
Yesterday, he told me, in front of my son, he wanted me to 'just move out and leave son behind'.
I feel he is trying to constructively evict me. But, also feel that this is a form of his (continued pattern) of domestic abuse (he has one conviction) and the heat lock is really a form of harassment.
Also, his comment about him wanting me to move out, said in front of our son was wrong; shouldn't have been said in front of our son. He says he 'doesn't care' (about where it was said).
My son was upset. I very concerned for my safety, at this point. And concerned that son's father can possibly get me to move out of the family home (we are not married; just have child in common).
I am primary caregiver and although have limited income, provide financial support within the home and to my son but this is discredited/undermined by the father.
Am I being harassed to the point that I can go to criminal court? He has one criminal court domestic concivtion (1997) for physically harming me in front of my son.

Re: Family Law (Harassment?)
Whether or not there is a strong case for criminal charges, you may find it worthwhile to file a petition for a family court order of protection. It's important that you consult with an attorney immediately to figure out the best way to protect your physical safety as well as legal interests.
