Legal Question in Family Law in New York

Family Law

My 13 sister is going to court for pulling the fire alarm at school and some other issues. I suggested to my mother that I go as well as see if my sister can come live with me to see if she can straighten her life up and make a change. My mom and my sister are at each others throats and my sister wants to move of out my mom's home. My sister wants to suggest to her law gaurdian that the judge place her in my care. What chance do I have on that happing? What are my rights to seek custody of my sister even on a temp basis?

Re: Family Law

You ask some difficult questions.

You may be a proper guardian for your sister. It would be better for all parties if your mom would agree to this for a temporary time (maybe three or four months). You may petition for custody but it will be up to the court and not you or your mom or sister. The court could also order foster care or even put her in a child detention center.

Whereever she goes, counselling should be part of the arrangment. Sounds like she and your mom could benefit from joint counselling so they can get through the teen years together.

Good luck.
