Legal Question in Family Law in New York

family violence and divorce help

We got married for 1 year, we keep fighting every week. During fightings, she slap me, scratch me on face and on arms. She used chief knife, hammer, any other weapons. The serious ones are: She smashed ceramic mug on my head, and used knife chop my shoulder bleeding. I tolerate her, of course, I fight back sometimes, once slapped her and caused her inner ear bleeding.

Last weekend, she keep fighting for about 15~20 hours. I lightly fight back. Then she use leather shoe as weapon, cause a 1-cm cut on my palm. I slap her back. she slap me 30 times. The next day, she was still unhappy. She use shoe bombard on my head and back for about 35 times. I still feel pain on my head.

She is living in such a ''saving'' way that every mistake I made will cost us a fighting, sometimes just for several dollars, sometimes several hundred dollars. Sometimes, a gift to friend will trig her envy. She think I care my friends more than her.

When she is not happy, I shall let her beat till she feel good. She changes her mood anytime. Some nights I left home in order not to disturb neighbour, after coming back, things get worse. I suggest her to see a pschologist, she doesn't.

I can't tolerate any more, I need a divorce. pls advice!

Justin

I emphatically agree with everything Atty Palazzo wrote.

First, stop the beatings and fighting, then go for the divorce.

Good luck,

You should go to family court and get an order of protection that prohibits her from striking you. The Fam court will help you complete the petition.

You can also ask that she vacate the home and stay away from you. First, stop the fighting then go for the divorce.
