Legal Question in Family Law in New York

if the father of your child was abusive and he was suppose to go to jail but ended up gettign a deal and now wants full custody can he win and does he still have that record even though i did not testify?

It's theoretically possible for him to win. One can't tell if he still has a record without knowing what the plea bargain was. If it was an adjournment in contemplation of dismissal there may be no record.
