If she is not contesting custody then there is no legal reason to appear although if I were her lawyer I would urge her to be present.
Should you like to discuss this or any other legal matter, you can call my office to schedule an appointment for a consultation or in the alternative, I can be reached for on-phone low-cost legal consultation at 1-800-275-5336 x0233699.

If she is agreeing to give you custody, almost everything can be done while she's away. Since you will want to enter the agreement in court and the judge has to approve it, the mother will probably have to appear in person at some point. If the case is going to be litigated, she can appear by telephone, although that would not be the best approach for her.

She may stay in Florida, although that sounds like a strange decision to me. You are welcome to a consultation at no fee at my offices at 42 west 44th st., NY,NY. Please call for an appointment first. (646) 591-5786
