Hi I am a father looking to fight for custody of my 4 yr old daughter. Her mother has made threats by text message to me and by phone to her mother that she'd kill herself and my daughter. Can these text messages be used during a custody dispute ? Thank you.

Yes, but if you take these messages seriously and do nothing about them......they wil backfire and hurt you. You will be considered as culpable as the Mother.
You need to make sure your daughter is safe. Call Child Protective Services, if needed, to investigate these threats.
Get into court on an emergency petition so the court knows you are concerned for your daughter's well being.
