Legal Question in Family Law in New York
A father has had primary custody of his 12 yer old for almost her entire life. The mother has had a long history of drug abuse, rehab, job to job and now currently has been charged with 5th degree criminal possession of crack cocaine in NY state. The mother had visitation rights.
What legal options does the father have regarding visitation, considering that the mother has been arrested. He also found out that one year ago she also was charge with a DWI that was reduced to a DUAI, also in NY state.

Go to family court for a modification of visitation. You can request that visitation be suspended or eliminated due to the danger to the child.
