Legal Question in Family Law in New York

I am a father who has an eight year old child, who wants to gain full custody of my little girl. I am married but not to the childs mother. The childs mother is at present homeless, she recently had an apartment. She had my daughter for the summer and I gained knowledge that there was no beds, or anything of that nature. Her to older children, both boys who where recently arrested for stealing cars also where living with her. The boys being only my daughters half-brothers, are also gang related. The young boy over the last three years was shot twice, this making me feel that in there company my daughter will always be at risk. Both boys where arrested and have been incarcerated for many different charges. I was called two weeks before the summer ended to come get my daughter because her electric was turned off.The next day I got yet another phone call the boys where arrested because they stole the plates of the car from the people next door. I also was told be family two houses away when I picked up my daughter the night before, that they had been feeding my daughter because she had no food. My daughter also has told me that mommy lets me stay up till 2am or more to watch movies and its ok because its summer. At present we have joint, I would like full custody. She also has family in P.A and I am worried she will take and run. I have a court date for 9/16/2010, the present order states she can have her on weekends, she wants her.How can I keep her safe till court?

You have a court date only 4 days away. Refuse to give any visitation except in your presence. Do not allow this child out of your sight. If you do not have representation, you should get some. This is not a case to handle yourself since it involves your daughter and not just you. Do not go into this forum as you would something you are not a specialist in. You would not perform surgery on your daughter and this is just as serious.
