Legal Question in Family Law in New York

Father's belongings

My dad died almost 18 years ago when i was six. Since my parents weren't married all of his belongings are with my aunt (his sister) not my mom. However, my aunt wants nothing to do with me because she doesn't like my mom so I can't get any pictures or anything that belonged to my dad. Since he died when I was so young these belongings would mean a lot tome. After she dies (she is pretty old) I am afraid all of his things will be thrown out since he has no other family left. Do I have any rights to his stuff and can I get them from her? I dont want money or anything, just things that belonged to my dad to help me remember him.

Re: Father's belongings

I assume that your father died and your aunt resides in NY. It seems reasonable to expect that you would have rights to at least some of your father's property through his will or intestacy, but you need to provide more details to figure out if you have a claim and, if so, whether it is time-barred. In any event, you should contact a qualified attorney as soon as possible.

Re: Father's belongings

A little help from an attorney, and maybe a strong letter may do it. It is not possible to tell what your rights are, and a lot of time has passed. Still, with some pressure from an attorney, your aunt may do the right thing.
