Father's rights in child custody battle

My son's mother took me court for child support claiming that for two years I had not given her anything. I was ordered to pay $25/month. After our break-up, I always gave her cash. Since I had no receipts I was ordered to pay backpay. The court also decided that I would continue paying the amount previously ordered. Instead I agreed to pay $80/week. She does things like sending my son to me with little or no clothes; or she would send him with dirty clothes. Other times she would find things for the two of them to do when I was scheduled to have him. I was layed off from work causing my child support to become backed up. Once I started working again, I had the enforcement agency take a little extra to help me cover the arrears(40% of my income). Well now my fiance and I have a 5 month old son of our own and it seems like the drama has begun again(Well it actually started while she was pregnant). Same stuff-my son has no clothes, etc. To top it off, my son was held back in school last year and continues to do horribly. I am thinking about taking her to court for custody. What would you suggest I do?

You can move for modification for a lower figure. If you want to pay more voluntarially you can.

If you are interested in moving for custody more facts need to be developed. See a lawyer quickly!! (or talk to a counsler in family court)
