Legal Question in Family Law in New York

Fathers last name

My unborn fathers want him to have his last name, we are not married have never been. Can he legally make me use his last name for this child? I would like it to be maiden name, same as my other childs. In NY have the laws changed to where if you are married the child gets the mothers last name?

You can give your baby any name you want to give him or her.
