Legal Question in Family Law in New York
Can I take away father's visitation for verbal abuse?
My 12 yr old daughter visits father every other weekend. Last weekend he made a comment ''pretty hard to paint a fence when you are ADHD'' (which my daughter is). He is also very prejudiced and was asking my daughter if I have a black boyfriend and if so, he should know about it because he doesnt want her around that sort of thing (i dont have any boyfriends). That is not a big deal, but he is always making prejudiced comments, which is something I dont want my daughter having any part of. He has previously beat a girlfriend up while she was in the house and just makes my daughter feel bad every time she is there. She does not like to see him, but I tell her she has to until she is a little older and can make that decision in court. How old does she have to be to say she doesnt want to visit? When she turns 16, old enough to get a job, will he be able to make her ''not work''. Thank you in advance for answering.

You should not be thinking in terms of taking any thing away. Certainly, YOU cannot take anything away. Suggest you think in terms of your daughter's best interests and then act accordingly.
If you are convinced that a limitation of visitiaton, or SUPERVISION, would be in her best interests, tben you can petition the court for that relief.
