Legal Question in Family Law in New York

Fathers Mean Words About Mother Hurting Kids

My ex and i were never married and Broke up 9 years ago.We have 2 children a son 12 and a daughter 9.I have custody. He has CHOSEN to only see the kids every other sunday for about 8 hours. He doesnt call in the week to check or talk to them. When the kids come home on sunday nights i can see that they are upset.I ask whats wrong they say daddy and their uncle are saying bad things about you. They tell my kids that im ugly,im stupid,im an idiot and so on and so forth. They tell them that its not true and that it upsets them but they dont listen and this goes one all the time. They are so hurt and upset by this nonsense and they dont even want to go there. There are lots of things that i can say to them about their father like he beat me into unconscienceness our whole relationship and almost killed my daughter when i was pregnant with her but i dont.If i dont have nothing nice to say i dont say anything. What can i do about this.My kids shouldnt have to deal with it.I know you could say talk to their father about it but believe me there is no talking to him.He has a filthy mouth so you dont even wanna know what he would say to me if i brought it up to him.It wouldnt stop anything anyways. Is there anything that can legally be done??

This is a difficult situation. You were very brave to get this man out of your life. It may be time for your children to do this as well.

His behavior is aimed at 'alenating' your children from you. The courts take this very seriously. Also, this visitation may not be in the 'best interest of the children'. It is possible to get a court order denying him any visitation or contact.
