No Fault Divorce

Can I get a divorce with the no fault divorce laws in New York?

What makes it difficult about the no fault divorce laws to get a divorce.. ???

Yes, you can get a divorce without grounds in NY. You have to enter into a separation agreement with your spouse, and file it with the county clerk, then one year after it is signed, you can file for divorce.

There is no reason not to use this type of divorce

There is no no-fault grounds for divorce in New York. You must have grounds. If the divorce is uncontested, there may be a way to work around this requirement.

If you and your spouse have lived apart for more than one year while you were legally separated, that is a ground for divorce, which is often referred to as "no fault."

If there was no legal separation, but you are both agreeable to a divorce, you may be able to obtain an UNCONTESTED divorce on one of the other grounds.

Suggest you consult with an experienced matrimonial attorney.
