Legal Question in Family Law in New York

My fiancee and i was suppose to married.but he passed away before our wedding date. his ex wife kicked him out of thier home and filed for a divorce a year later .she stop the divorce when he pass .can his mom get her for abandenment. since we lived together and had a child together.and does having a police report against her make a difference.

Since he was not divorced, his wife is one of the beneficiaries of his estate. Your child is also a beneficiary and can sue for part of his estate. The police report is meaningless in this situation and abandonment is only part of the issue for the surrogates court. You need an experienced estate lawyer.
