Fighting for Child Support
I am a single mother of 2 children, my husband and i split up approximately 2 years ago. He signed a seperation agreement at that time stating that he would pay so much a week. After 2 years of not paying my attorney finally decided to take him to court for a divorce. The first time we went was in March of 1998 and he was ordered by the judge to start paying me the following week. He paid me once. After going to court again in April 1998 and being ordered by the same judge to start paying support to support collection so they could keep track of it he still is not paying. My attorney who i have been trying to call for 3 weeks has not returned a single phone call, i cannot get ahold of the judge to ask him what to do. This guy is getting away with paying nothing at all and no one will do a thing about it. I am at a standstill and do not know what to do from here. Any help you can give me will be appreciated. Self Help - non payment child support
You may want to file a violation of support order petition in family court. Easy way would be to contact the Support Collection Unit and see what they can do. Note that if this is a pre-divorce, temporary order that is in effect, it may be better to bring on a contempt proceeding in supreme court.Your attorney should respond to you otherwise I would suggest that you send him a certified letter/return receipt advising him to contact you within 5 business days and if not contact the grievence committee of your local bar.
