Legal Question in Family Law in New York

Fighting over a house

My mother was recently put into a nursing home, I had been the caregiver for almost 20 years in a house that my mother and father bought. My father past almost 15 years ago, and I am still living in the house. The house is owned by me, my sister and brother. My sister wants her niece and son in law to move in, she lives across the street from the house, and the niece is now pregnant. They want to kick me out, I am paying all the bills. What are my rights?

Re: Fighting over a house

You are in title and possession, so you cannot be removed from the house. However, the sister may start a partition proceeding to force the sale of the house.

My suggestion is that you should talk to your sister about purchasing her share of the house for its fair market value.

Mike.
