Legal Question in Family Law in New York

Can I file a Motion or Petition?

My ex and myself are going through a relocation trial right now. Judge has ordered Forensic testing for all which includes my ex, myself and 8 year old twin daughters. My ex wants to relocate to Fl. with them. The girls were appointed a Law Guardian and the girls told the Guardian that they--name removed--NOT want to move away.My ex has totally alienated me from my girls lives since she started all this nonsense with relocation. My question, can I file a Motion or Petition in Family Court at this time stating ''Parental Alienation'', even though we are going through a trial right now?Can you suggest what else if not Alienation I can file in a Petition that my ex is not allowing me communication with my children?Thank you very much.

Re: Can I file a Motion or Petition?

If you are going through a trial right now, as you say, you should address all your questions to your attorney (who would presumably be much more familiar with your case than anyone responding here).

If you do not have an attorney, get one.

At the very least, you should consult with an experienced matrimonial attorney.

With the limited facts presented here (in the middle of a trial), no attorney can give you any meaningful advice or recommendations.

I practice in NYC and Long Island.
