Legal Question in Family Law in New York

My ex filed for legal separation last year. It was agreed in the paperwork that he would pay half of the debt and has since stopped paying a dime, and has left the state. What is my legal recourse? Can I garnish his paycheck?

Your first course of action is to bring an motion or petition in either Supreme Court or Family Court to enforce the terms of the divorce settlement. Once you have either a default judgment or decision of the court you will need to find him and domesticate the judgment in that State. Then you can garnish his wages in some cases.

You should contact an attorney to discuss this further and to see what you can do specifically.
