Legal Question in Family Law in New York

My ex filed to have our parenting agreement modified with him having sole custody and my visitation schedule extremely limited. The facts alleged for reasons are bogus. If I can show this is frivolous, can I ask for it to be dismissed? If so, how long do I have? I was told that there was no opportunity to counter this and it had to run its course but this just seems wrong.
