Filing for divorce

I wish to file for a divorce can i do that if there is a custody hearing pending

Yes, an action for divorce and an action for a custody hearing are independent.

You can, but you should know there is a possibility the custody case may be transferred to the Supreme Court then the parties will be responsible for all the costs. These can include, among other things, guardians (usually a lawyer) to represent the children, psychologists to interview the children and make recommendations.
