Legal Question in Family Law in New York

Filing legal separation forms

My husband and I still share the same postal address, but he has moved to a temporary location until he can get his own apartment. When filling out separation forms,if our property is already divided and we've checked ''A'' under Article IX, do we still need to submit a form 10 Satement of Net Worth? And would we have to fill out Article III? Thanks for any help.

Re: Filing legal separation forms

You can waive the filing of statement of net worth by stating that each of you have had a fair and reasonable opportunity to research the finances of the other and waive the filing of net worth statements.

Re: Filing legal separation forms

My condolences on this event. It is very hard for both of you. It sounds like you are both trying to get it done without unnecessary malice.

How do you fill out the forms? Which forms are you using? The Blomburg?

I recommend filling out everything and let the court sort it out. The court likes to review the agreement and inform the parties if there is something out of the ordinary. In addition, when you have no lawyer, the judge often tries to make sure each party is informed of their rights.

You may avoid a court appearance if you provide the information now. Of course, the Judge may call you in for a conference anyway, but this may minimize the the likelyhood of that happening.

good luck.
