Legal Question in Family Law in New York

filing petitions

my son is in the custody of ocfs and has been since 2005, he was court ordered to have intensive mental health therapy, to this day he has not recieved any, can i file a petition to have him removed out of their custody and have they violated the judge's orders by not giving him this help

Yes, and Yes.

If you want to win this however, I strongly urge you to find a lawyer who knows something about both family law and mental health issues. You may need an expert witness as well. A court will not treat a governmental agency the same way as she treats an individual parent.
