Follow Up: Child Support
I should have offered more detail...
This child is 17 and a full-time student. Can I actually carry this to Family Court without a court decree stating that I am custodial parent? If I take this to Family Court - can't I potentially be held liable for back support that I did not pay during my daughter's residency with me? Since there was no legally documented arrangement of my not making payments (even though physical residency of my daughter changed) it would seem to me that my ex-wife could sue me for back support even though the daughter didn't live with her. I'm convinced that my ex wife would indeed do that, if it were an option.
2 years ago my daughter came to live with me after her mother kicked her out of her home. I was paying $600.00+ a month in child support. I attempted at one time to get my ex-wife to sign a document that a lawyer compiled waiving my requirement to pay support and in turn, my ex wife pay support. My ex wife refused to sign the document and now after 2 years hasn't paid a dime in support to my daughter. I don't need this money - but my daughter does, for college, auto etc. What are my options? Small claims on behalf of my daughter?
