Legal Question in Family Law in New York
Can I be forced to stay in NYC?
My ex hadn't provided support for our child pretty much all year,so I moved to florida from new york. I informed him one month prior to moving that i was leaving to florida.I came back on a visit and was served with papers, he wants custody. He was granted temporary visitation on alternate weekends until the adjourned date feb 24 2003. until then I have to stay in ny. his basis for custody was that i have a history of drug abuse (false) and that i cant provide a safe and stable home for her because of no permamnent adress (false) if i stay here i will lose my job and home. is there anything i can do?

Your lawyer could bring an Order to Show Cause to vacate the TRO, or at least to ACCELERATE the return date and get an early hearing. You should also move for PERMISSION to relocate to Florida. In the meanwhile, get drug tested, etc.
