Legal Question in Family Law in New York

Fraudulent divorce

Is there such a thing as a fraudulent or illegal divorce in New York State, if you have a transcript and testimony during a trail for equitable distribution where the plaintiff admits that they never gave there lawyer or anybody a copy of their W2 forms or income tax returns and stated that they were store at home or some other place? Can this divorce be overturned because of this? Can a motion start the ball rolling even though the divorce was granted a year ago and the equitabel distribution trial was 7 months ago? There are notices of appeal for both trials.

Re: Fraudulent divorce

There is insufficient information set forth here to permit a proper answer.

Suggest you obtain a Second Opinion from an experienced matrimonial attorney BEFORE you bring any motions, etc.

Re: Fraudulent divorce

Grounds for divorce are separate from the distribution of marital assets. The divorce will not be overturned if your basis is fraud in a trial for equit. dist. Since you said the divorce is being appealed there may be other grounds for same.
