Legal Question in Family Law in New York

My friend has a child support order that is $7000 behind but he has always lived with his child since birth and he has been unemployed for more than a year all the while the money is accruing. What can he do?

It is odd, he didn't get this resolved when the child first moved in with him or within he first fell behind.

In any event, he can request a modification of custody and child support based upon his current living arrangement. In the petition, he should give background on how he has supported the child during the child's life. If possible, the mother of the child should sign an affidavit and appear as a witness in the matter. The court may still hold him in contempt. However, it should stop the bleeding.
