Legal Question in Family Law in New York

just a friend or g/f?

Live in ny...husband was/is still seeing a female coworker even before he filed for divorce...occasionally bringing the children around to meet her and telling them that she's a ''friend''..Is he allowed to do this before filing and after filing for a divorce? we are still married...His car has been spotted outside her house even when children arent with him and on evenings after work when he should be home with children and he doesnt come home....

Your question belies a different set of questions. Do you believe he is having an affair?

Do you have proof of same?

Would you divorce him if you were sure he was NOT having an affair?

Would you have grounds for divorce (abandonment from home or bed; cruel and inhumane treatment?)if there is no adultery?

Your answers to these questions make the other question relevent. If he was bringing his kids to meet a male co-worker or friend, would you mind? IF he was hanging around said male co-worker after work, would that raise the questions you are asking?

The direct answer to your question is that unless you can show that the person who he is bringing his kids around is a danger to the kids, then no it is not wrong for him to do it.

What you really need though is not an answer to the question you asked, but a sit down with a matrimonial lawyer whom you can discuss your fears with and who will give you good counsel in this matter. Do not wait until he starts the law suit or he moves out. The time to protect yourself is when you first feel a suspicion. You are well past your time to see a lawyer.
