Legal Question in Family Law in New York

my friend would like to move to florida from ny with her kid. she has sole custody of her child due to the fact that the father never showed up to the court date. He is a dead beat dad. Rarely sees his son, or pays child support, is a drug addict, and generally doesnt seen to care for the childs well being. My friend thinks that he is going to give her a hard time about moving just because he wants to ruin things for her and not because he cares about the child. This move is the best thing for her and her son. She will be able to afford a better life for them there, where as she is struggling here and not getting any help from him. Is there any way she can move with permission from the courts?

She can get permission from the court by filing a Petition in family court. If moving out of state would be in the best interest of the child, and if the father has little or no interest in visitation with the child, the court would likely grant it.
