Legal Question in Family Law in New York

Hi A friends sisters' husband was spending a lot of time with a younger divorced woman.She had a baby on August 13. He was sneaking out of the house at night after she moved into her house around October 31 and was meeting her at his work and also at a local restaurant.My friend was charged with harassment after he confronted him about his possible affair and now has to go to talk with the DA in the future.Would it be possible to have her charged with adultery if the DA wont drop the charges against him for harassing his sisters husband?Could that possibly scare the cheating husband into dropping the charge also??Thanks for any advice you may have.My friend doesnt have internet access and I 'm trying to help him.This is in New York State and evidently adultery is still on the books as a felony or misdemeanor

The chances of getting someone charged with adultery in New York is somewhere between zero and less than that.

You should also know that at this point it isn't up to the complaining witness to drop the charges.

Your friend should not speak with the DA directly, but rather should speak to a lawyer.
