Legal Question in Family Law in New York
Full Custody without getting ugly
My son is now 10 months old and his father and I were together for 7 years unmarried I moved out before I found out I was having him. Although he came to see him on an almost regular basis he provided no support financially. He is verbally abusive and explosive saying things that he wants my son to grow up to hate me and he wishes i would just die. I want to file for full custody and want to keep him away from us. He is a very unstable person and has a lot of hate and anger I just dont want me son around. I know he loves his son but I want my son to have a stable healthy father which he is not. How do I file for full custody with him getting visitation he has not seen him in almost over a month and I have asked him to and he refuses. I dont want him coming in and out of my sons life. I also do not want any support from him. He is on my sons Birth Certificate. I know in court he will act and behave like a calm caring person and I am scared the judge will not see the real him and grant him joint custody.

Re: Full Custody without getting ugly
Since you were not married to the Father, you already have FULL, legal and sole custody.
The Father will have to file a petition for joint custody. At that point, you will explain all to Judge and request supervised visitation only, for the Father AND CHILD SUPPORT!
The support is the right of the child, do not deny the child this right.
