Legal Question in Family Law in New York

Garnishment of Wages from New York to California

Divorced in NY. Wife lives in NY. I live in Calif. Wife wants to have wages garnished. Not child support or alimoney, credit card debt. Decree says I pay 800-1K per mo. for 16 mo. If I pay less due to wages being $2350 mo, can she do this? I also pay $906 mo. for child support in CA. There may be a dispute of the amount of debt owed, due to her misrepresentation of facts. Can I have the decree re-opened and modified?

Yes. Will you suceed? You give too little in the way of facts. What do you wish to modify? Child support because you can't afford the current level due to the fact that you also have to pay her a debt. Not likely. Need more info.

you can ask for modification any time but you must show a material change in circumstances.
