Legal Question in Family Law in New York
possible grandparent
I may be a grandparent and want to know, if any, what my rights are.
A girl said she had a child by my son. She already has a child from someone else. My son told me repeatedly he's not sure this child is his. The girl told him the child wasn't his and named someone else. He said he wants a DNA test but hasn't done it due to cost. The girl is disrespectful but I got along with the girl's mother. I last held the child was the day he was born and haven't seen him since. Despite unclear paternity, I saw myself as grandma.
That all ended when the girl, her mother and kinfolk (all on welfare and drugs) packed in a car, looking for my son at my different relatives homes, including mine. They've acted ghetto& done this many times. I later found out that the girl was jealous. He's still w/ his girlfriend of 4 yrs and she can't stand it. My son was raised better than that and his behavior is wrong. This girl and my son are over 21 & don't get along. He sees this child occasionally. The girl doesn't want the child around our family b/c she knows we question the child's paternity.
After all that, my family and I don't want nothing to do with them but we want to verify paternity and have a relationship.

Re: possible grandparent
Your son is the only one taht can challenge paternity. He needs to file a Paternity petition in Family Court. A DNA will be ordered by the Support Magistrate and if he is the father then you can petition for grandparent's visitation.
