Legal Question in Family Law in New York
Grandparents Confused on Their Rights
My 4 month old Grandson was brought to me by CPS, because of a report of Domestic Dispute in his home. His Father is my son. On July 18th, we were turned into CPS w/ allegations not pertaining to any harm to our Grandson. Therefore, he was placed in Foster Care. I filed a Custody Petition w/ the help of my Attorney. We've been to Court 4x. My Grandson's parents each have an Attorney. We've been told by CPS & Social Services that Visitation while he's in Foster Care, was up to ''always someone else''. I just found out that we have the right to see him 1 hr a week & we were never notified! Last time in Court, the Mother was ordered to go to a DV Shelter w/ the baby for 30 days. My son was told by his Lawyer that he could go see her anytime. But we were told by CPS & DSS to report it if they were seen together. We were told our Visitation Petition would be heard on the 14th of Aug. My son called me to warn me that their 2 lawyers are putting me on the stand that day to Badger my Past. I was never told that. My son says he doesn't want to see that happen to me. My lawyer has had trials & unable to make appearances & can't make it on the 14th! And I can't get my retainer back. Please help.
