Legal Question in Family Law in New York

Grandparents legal rights

My granddaughter will be adopted by her maternal great-grandparents. Can they legally put someone else in their will to care for her if something were to happen to them? What are my rights as her paternal grandmother in this case? My granddaughters parents are not married.

Re: Grandparents legal rights

Custody of a child is not determined by a will.

The issue of custody is always before the court and can be modified, in the best interests of the child. The same applies to visitation, which is a specie of custody.

If you wish to discuss this with me privately, please call to schedule a consultation.

I practice in NYC and Long Island.
