Legal Question in Family Law in New York

Do grandparents in N.Y. have visitation rights?

My question is do grandparents in the state of N.Y. have visitation rights if their child has decided not to let you see your grandchild anymore after 2yrs. and 4 months? This child has lived in my home since he was 2 days old.

Grandparents may apply to the court for visitation rights under section 72 of the Domestic Relations Law. However, grandparents do not have the same rights to visitation that parents have, and the court may be reluctant to award visitation to grandparents over the parent's objection. The court must give extra weight to the parent's determination as to whether visitation with the grandparents is in the child(ren)'s best interests.

Grandparents do have visitation rights however they are not absolute, a parent may exclude such visitation with a showing of good cause. If you need further info you may call my office to set up a consultation @718-834-0087.
