Legal Question in Family Law in New York

Grandparents rights.

My son was court ordered to visit his grandparents one weekend a month. Now that he is getting older (he is 12) he doesn't want to go anymore. He has been doing this for years. Will the court respect his wishes? What age will they listen to him?

Re: Grandparents rights.

Why does he not want to go? Are the grandparents abusive? Are the visits boring? Maybe you should speak to the grandparents about making visitation meaningful. Trip to the museum, zoo, ballgame?

You should also attempt to foster a good relationship between the child and the grandparents. Talk to the child and explain the reason behind visitation; that it is good to know the grandparents. That the grandparents love the child.

If that does not work you may (on behalf of the child) petition the Family Court to stop visitation. However, for the court to respect his wishes he must give a good (and I mean GOOD) reason why he does not want to see his grandparents. I don't feel like it does not cut it.

Mike.
