Legal Question in Family Law in New York

grandparents' rights

My son recently passed away. He has a 9 month old son with his girlfriend. She is going to be moving out soon and we are afraid that she will not let us see our grandson. If this occurs, do we have the right to take her to court for visitation?

Re: grandparents' rights

Ordinarily, it is difficult for grandparents to get visitation over a parent's objection - one needs to show a special relationship with the child. However, it sounds like the child has been living with you; if so, then you may have a good case and should probably file a petition in Family Court some time very soon, if not immediately. Feel free to call our office to discuss your case in further detail.
