Legal Question in Family Law in New York
Granparent and visitation
My Husband and i do not want his father to be able to take our kids to his home for visitiation as we do not like the atmosphere. We plan to move and believe that this could start a visitation case(we live next door) My FIL has had very little to do with the kids,he will not come to our home because his girlfriend is not welcome. She has a personality disorder/bipolar and can get violent and moody and says mean things to fil and anyone else around, she also admits to hating my 10 year old son so his home is not a place i want my kids even with husband and i let alone unsupervised.Because she is not in any way related to the kids is there a way we can stipulate that says she cant be around our kids if he gets visitation? Grandfather has pretty much ignored kids for past 3 years and will slip a card under the door for birthdays when we are not home but no emotional loving regular contact ...would a judge see this as a grandfather deserving of visitation?

Re: Granparent and visitation
generally parents control visitiation, i think youre getting a little ahead of yourself... you have every right to deny any visitation
