Legal Question in Family Law in New York

What are the grounds for an Annulment?

I would like to know the grounds for an annulment and if they pertain to me how do I go about obtaining one?

Can I get remarried in the Catholic Church without one?

If you are concerned about being remarried in the Catholic church, I assume you are concerned about a spiritual annulment. This is something you must speak with a priest about.

I am not catholic, but I don't think you need a legal annulment to get a catholic annulment. I have known people that have been legally divorced who were able to get catholic annulments.

Re: What are the grounds for an Annulment?

Fraud, lack of age, being already married

and not able to consumate are the grounds

for a state annulment, which is basically

a statement that the marriage was void and

never happened. This is extremely rare.

This is also different from an ecclesiatical

annulment which is needed to remarry in the

Catholic Church. This process must be handled

through the Church and does not normally

involve attorneys at all. Talk to your

priest about this.
